Agora S.A. and all of its affiliated companies (within the meaning of the Polish Accounting Act of 29 September 1994) (hereinafter jointly referred to as: Agora) acting as a publisher of websites and mobile applications and as a provider of services within these websites and applications expressly state that they do not authorize any reproduction, use or storage of the following content on Agora's websites, web services and mobile applications:
(1) content, including in the form of text and data, as well as audiovisual, audio, photographic or graphic material, in particular constituting parts or the entirety of copyrighted works, artistic performances, phonograms, videograms, broadcasts or press publications constituting the subject of the publishers' related rights (hereinafter collectively referred to as Materials);
(2) databases;
(3) computer programs;
for the digital mining of the Materials, databases or computer programs (including analysis using automated techniques) to generate information including, in particular, patterns, trends and correlations. The disclaimer applies in particular to the mining of Materials, databases or computer programs for direct or indirect financial gain and to the creation, modification and training of machine learning technologies and web algorithms, including systems using generative artificial intelligence technology or the products of such systems.
This disclaimer does not apply to content mining carried out for the purpose of determining the positioning of web pages containing web services within the scope of indexing search engine results. Furthermore, Agora declares that this disclaimer is not intended to and may not be interpreted as excluding or restricting the rights of the consumer to use the content resulting from the authorization given to the consumer by Agora (in particular on the basis of an agreement between Agora and the consumer) or the use of the content by the consumer within the scope of permissible use as defined by the applicable law.
The indication constitutes a reservation of the rightholder about the lack of consent for the reproduction of distributed copyrighted works for the purpose of text and data mining referred to in Article 263 (1) and (2) of the Act on Copyright and Related Rights (i.e. Journal of Laws of 2022, item 2509, as amended) and Article 4(3) of Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC and 2001/29/EC (OJ EU. L. 2019, No. 130, p. 92), as well as within the meaning of the provisions implementing the indicated Directive into the national legal systems of all Member States of the European Union.
Any reproduction, use or storage of the Materials, databases or computer programs indicated above, performed without Agora's prior, explicit permission, constitutes an infringement of Agora's rights and will result in legal action to protect Agora's rights, including seeking appropriate remuneration or compensation.
